Despite your best efforts, accidents can still occur, making it essential to be thoroughly prepared and positioned to safeguard the companies and individuals interests in the event of a health and safety incident.
In this trial, the defendant, a Supervisor for a groundworks contractor, is accused of breaching section 7(a) of the Health and Safety at Work Act 1974 following a cable strike incident that tragically resulted in the death of an agency worker. The Health and Safety Executive (HSE) alleges that the Supervisor failed to adhere to the Principal Contractor’s policy on safe excavations, permitted work without a Permit to Break Ground, fostered a culture of fear, and provided inadequate supervision. As part of the audience, you will take on the role of the jury, deciding whether to convict or acquit the defendant. Your task will be to determine whether the prosecution's case is fair and justified or if the Supervisor is being unfairly scapegoated.
